1 Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of ListGenic.com, operated by Santana Realty Group, LLC, a Florida limited liability company doing business as ListGenic.com ("Company," "we," "us," or "our").

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2 Description of Services

ListGenic.com provides a digital platform that enables For Sale By Owner (FSBO) home sellers to manage property showings and connect directly with prospective buyers and their agents. Our services include:

• Online showing request submission and management
• Automated email and SMS notifications for showing coordination
• Seller dashboard for managing availability and appointments
• Buyer feedback collection tools
• Showing reminder and follow-up automation

ListGenic.com is a technology platform only. We are not a licensed real estate brokerage and do not provide real estate brokerage services, legal advice, or financial advice.

3 SMS Communications & Consent

Consent is not a condition of purchase. You are not required to consent to SMS messages to use our platform.

To opt out: Reply STOP to any SMS message at any time. You will receive one confirmation message, then no further SMS messages will be sent.

4 User Accounts & Eligibility

To use our platform you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be legally authorized to sell or purchase real property in your jurisdiction

You are responsible for all activity that occurs under your account. Notify us immediately at support@listgenic.com of any unauthorized use.

5 Seller Responsibilities

As a seller using our platform, you agree to:

• Provide accurate property information and availability
• Respond to showing requests in a timely manner
• Ensure the property is accessible and safe for showings
• Comply with all applicable fair housing laws and regulations
• Not discriminate against buyers based on any protected class
• Honor confirmed showing appointments or provide reasonable notice of cancellation

6 Buyer & Agent Responsibilities

As a buyer or agent using our platform, you agree to:

• Provide accurate contact and financial qualification information
• Attend confirmed showing appointments or cancel with reasonable notice
• Treat seller properties with respect during showings
• Not share showing access credentials with unauthorized parties
• Provide honest feedback when requested

7 Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose or in violation of these Terms
• Submit false, misleading, or fraudulent information
• Harass, threaten, or abuse other users of the platform
• Attempt to gain unauthorized access to other users' accounts or data
• Use the platform to spam, solicit, or advertise unrelated services
• Interfere with or disrupt the platform's functionality or servers

8 Fees & Payment

ListGenic.com charges sellers a platform access fee as described at the time of registration. All fees are clearly disclosed before payment is collected. Payments are processed securely through Stripe.

9 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

ListGenic.com is not responsible for the actions, conduct, or representations of any seller, buyer, or agent using the platform. We do not guarantee that showings will result in offers or sales.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SANTANA REALTY GROUP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability to you for any claims arising from these Terms or your use of the platform shall not exceed the amount you paid to us in the 3 months preceding the claim.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Brevard County, Florida.

12 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the platform after changes constitutes acceptance of the updated Terms.
